Vol. 537 No. 2

Written Answers. - Defence Forces Strength.

Michael Creed

Question:

134 Mr. Creed asked the Minister for Defence if he will investigate the circumstances surrounding the discharge from the Defence Forces of a person (details supplied) in County Cork; if he has satisfied himself that this person is in receipt of all of his entitlements regarding pension and disability payments arising from his service in the Defence Forces; and if he will make a statement on the matter. [15585/01]

The person in question relinquished his commission as an officer of the FCA with effect from 7 August 1956 for the reason that he was below the required physical standards. He had been injured in a road traffic accident in June 1955 while on duty and he subsequently received compensation on foot of a civil action against the driver of the vehicle.

While he was found eligible at the time for an award of periodic compensation in accordance with the terms of the Emergency Powers (Compensation for Personnel Injuries) (Local Defence Force) Scheme, 1942, no payments were actually made to him because the relevant amount of periodic compensation was less than the actuarial value of the compensation which he had received.

The person is not in receipt of any payments from my Department. I have asked the Department to undertake a review of the case and I will advise the Deputy of the outcome in due course.
