Question:

95 Ms Shortall asked the Minister for the Environment and Local Government the position in relation to a person (details supplied) in Dublin 9 who surrendered a full driving licence in 1987 due to disability and passed a driving test for an F licence and subsequently a B licence, and who now, following two operations, is certified to be medically fit; if this person can revert to a full driving licence without undergoing a new driving test; and if he will make a statement on the matter. Under the Road Traffic Act, 1961, and the Road Traffic (Licensing of Drivers) Regulations, 1999 to 2001, it is a matter for the appro priate licensing authority, in this case Dublin Corporation, to determine the eligibility of a person for a driving licence and to issue licences. The licensing regulations require that an application for a driving licence be accompanied by a certificate of competency, obtained by the passing of a driving test, where the application relates to a driving licence for a category of vehicle which is not limited to a specified type of vehicle in that category and the applicant has not held a driving licence in such category at any time within the period of ten years preceding the date of application.
