Question:

313 Ms Clune asked the Minister for the Environment and Local Government the extent of an unlicensed hazardous waste dump at a site (details supplied) in County Cork; the group or person which is responsible for the clean-up of this site; and if he will make a statement on the matter. [18822/01]

The Environmental Protection Agency Act, 1992, provided for the establishment of an integrated pollution control, IPC, licensing system in respect of large industrial or other activities with significant polluting potential and assigned to the Environmental Protection Agency responsibility for implementation of the licensing system.

I understand that, in the case referred to by the Deputy, an IPC licence was granted by the EPA to the company concerned on 22 June 2001. Enforcement of the licence is a matter for the agency; I am precluded under section 79 of the Act from exercising any power or control in relation to the performance by the agency in particular circumstances of a function assigned to it under the Act.
