Question:

245 Mr. Ring asked the Minister for Agriculture, Food and Rural Development when a person (details supplied) in County Mayo will receive an area based payment. [22913/01]

The person named included 27.48 hectares in his 2001 area aid application. An area of 27.38 hectares was determined which is some 0.10 hectares or 0.37% less than the area claimed.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. Therefore, in this case no penalty is applied, leaving the area determined for payment purposes at 27.38 hectares. Any payments due will issue as soon as possible.

246 Mr. Ring asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Mayo has not received a 2000 headage payment. [22914/01]

The application form for the person named was not received until 24 May 2000.

The latest date for receiving late applications was 23 May 2000. Therefore, in accordance with EU rules, this application was inadmissable and no area aid linked payments can be granted to the applicant.
