Jimmy Deenihan

Question:

239 Mr. Deenihan asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Kerry did not receive area-based payments in 2001; and if he will make a statement on the matter. [23850/01]

The person named submitted his area aid application after the 27 April 2001 closing date. Late applications incurring daily penalties were accepted up to 22 May 2001. As the application form for the person named was not received until 31 May 2001, a 100% penalty was applied in accordance with the EU regulations. Consequently, no disadvantaged areas compensatory allowance scheme payment can be made for 2001.

240 Mr. N. O'Keeffe asked the Minister for Agriculture, Food and Rural Development if he will refund payments made by a person (details supplied) in County Cork. [23853/01]

The owners of farm animals are responsible for ensuring that their animals are prevented from wandering on public roads or into other places. In the wake of the foot and mouth disease crisis it is more essential than ever that farmers ensure that fields are properly fenced. Where cattle are found wandering, they are usually detained in pounds until the owner can be located and the identity of animals is established. The question of payment for the detention of such animals is one between the herd owner concerned and the owner of the pound.
