Question:

405 Mr. Ring asked the Minister for Social, Community and Family Affairs when an appeal will be heard against a decision to refuse an application by a person (details supplied) in County Mayo for a non-contributory pension. [23799/01]

The appeal of the person concerned against the decision on her widow's non-contributory pension was the subject of an oral hearing on 17 May 2001. The evidence adduced at the hearing and further correspondence received on her behalf since is being considered by the appeals officer and a decision will be made shortly.

Under social welfare legislation decisions in relation to claims must be made by deciding officers and appeals officers. These officers are statutorily appointed and I have no role in regard to making such decisions.
