462 Ms Shortall asked the Minister for Justice, Equality and Law Reform the number of prosecutions taken under the Explosives Act, 1875, in respect of fireworks offences for each of the past five years for which figures are available; the number of persons who have been successfully prosecuted for fireworks offences in each of the past ten years; if his Department has concluded the review of this legislation; if so the outcome in this regard; the nature of the discussions his Department has engaged in with the gardaí in respect of improving the Act to curb the sale of illegal fireworks; the plans he has to update the Act, particularly the penalties and fines in the Act; and if he will make a statement on the matter. Details concerning prosecutions in relation to offences under the Explosives Act, 1875, and the Explosives Act, 1883, are published annually in the crime reports. However, I have been informed by the Garda Commissioner that details relating to offences concerning fireworks are not readily available and could be obtained only by the expenditure of a disproportionate amount of Garda time and resources. The review by my Department of the Explosives Act, 1875, is ongoing in conjunction with the Garda authorities. Pending finalisation of the review, it would be inappropriate for me to comment on any aspects of the likely outcome of the review.
