226 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if a person (details supplied) has received the correct amount in area aid related payments for 2001; the reason this payment has been reduced; and if he will make a statement on the matter. [27769/01]

Under the terms and conditions of the 2001 area aid scheme, the applicant must ensure that only eligible land is included on his area aid application. The person named included two ineligible areas in his area aid application, comprising buildings, trees or other invalid land totalling some 0.25 hectares.

The herd owner applied for area aid in respect of a total of 14.07 hectares but after deducting the ineligible land, a valid area of 13.82 hectares has been determined which is 1.81 % less than the area claimed.

Under Article 9 of EU Regulation 3887/92, no penalty is applied when the difference is less than 3%. Therefore, in this case no area aid penalty was applied, leaving the area determined for payment purposes at 13.82 hectares.

The person named was paid £984.88 under the 2001 area based compensatory allowance scheme on 25 September 2001 in respect of 14.07 hectares of more severely handicapped land at £70 per hectare. This compares with his average payment of £899.60 in the years 1998, 1999 and 2000. He was due payment on 13.82 hectares at £70 per hectare, resulting in an overpayment of £17.48 on the difference of 0.25 hectare. The overpayment will be recouped from future entitlements of the person named.

Question:

227 Mr. G. Reynolds asked the Minister for Agriculture, Food and Rural Development the reason a person (details supplied) in County Leitrim has not received payment of a 2001 suckler cow premium. [27770/01]

The person named applied on 11 cows and two heifers under the 2001 suckler cow premium scheme. Following an examination of his application it was found that the calving dates for a number of animals required further clarification. Documentation submitted by the person named is currently being examined and a decision regarding his application will be made known to him shortly.
