81 Mr. T. Hayes asked the Minister for Agriculture, Food and Rural Development the reason an application by a person (details supplied) in County Tipperary for additional milk quota for products affected by foot and mouth animal movement restrictions was refused; and if he will make a statement on the matter. [28342/01]

The person named leased his quota with land to a family member in the current quota year. He continued to make milk deliveries until May this year. Under the normal rules, these deliveries must be credited against the quota which he held and only the balance of that quota will transfer to the leasee in the current year. All of the quota will, of course, transfer with effect from 1 April 2002. Since the deliveries made in this case are, therefore, within quota, there is no justification for an allocation from the reserve set up to deal with foot and mouth disease restrictions.
