208 Mr. Deasy asked the Minister for Finance the State bodies which have been included under the Freedom of Information Act; the bodies which have been excluded; and the reason they have been omitted. [30668/01]

At present, the FOI Act applies to the public bodies set out in the first schedule to the Act, including those that have been prescribed in regulations since the Act came into force. Following is a list of these bodies together with other bodies that have been earmarked for inclusion under the first schedule next year.

Comprehensive information regarding State bodies that are not included under the first schedule is not held in my Department. In order to be helpful to the Deputy, I have included a list of bodies under the aegis of my Department that are not included in the first schedule and I have asked my officials to request other Departments to supply the information requested directly to the Deputy. This list does not include subsidiary organisations and groups such as the Euro Changeover Board of Ireland and the committee on top level appointments in the Civil Service whose records are deemed to be under the control of my Department and, therefore, accessible for FOI purposes.
No State bodies are excluded from the FOI Act as such. Rather, the first schedule sets down criteria under which additional public bodies may be prescribed in regulations. The process of extending FOI in this way has been incremental. When the Act came into force in April 1998, it initially applied only to Departments and offices and to certain closely related bodies. Since that time, the Act has been extended gradually as experience has been gained in its application. In October 1998, it was extended to health boards and to local authorities. One year later, it was further extended to certain statutory agencies in the health sector, publicly funded voluntary hospitals and voluntary organisations which provide substantial public mental health services or services to persons with an intellectual disability. During 2000, the Act was extended to bodies in the broadcasting sector including RTE and TG4, to bodies in the environment, social services, cultural and regulatory fields and to certain bodies providing services to persons with a physical disability. This year has seen further extensions to bodies in the enterprise-support area, such as IDA Ireland, Forfás, Enterprise Ireland, etc., and third level education, including universities, institutes of technology and colleges of education.
The Government is committed to further extending the FOI Act. Earlier this year, it decided, in principle, that the Act should be extended to cover remaining public bodies by no later than end 2005, subject to examination on a case-by-case basis and commencing next year.
