415 Mr. Spring asked the Minister for Education and Science the details of his decision and announcement to set up a sworn inquiry into certain matters at the institute of technology, Tralee, County Kerry. [30790/01]

416 Mr. Spring asked the Minister for Education and Science the terms of reference for the sworn inquiry to be set up arising from matters pertaining to the institute of technology, Tralee, County Kerry; if he has appointed personnel to conduct the said inquiry; when he expects the inquiry to commence; and the location of the inquiry. [30791/01]

I propose to take Questions Nos. 415 and 416 together.

Following consideration of the report of the inspector whom I appointed to inquire into certain matters relating to the operation and management of the institute, I have decided to establish a sworn inquiry into a number of issues arising from the report. The inquiry will be held in accordance with the terms of sections 105, 106 and 107 of the Vocational Education Act, 1930, as amended by section 26 of the Education Act, 1998.

Officials of my Department are currently engaged in making arrangements for the initiation of the inquiry. In this regard it is necessary to consult with the Office of the Attorney General in relation to certain matters before I appoint a person to conduct the inquiry. I do not propose to publish the terms of reference for the inquiry until these consultations have been completed. No decisions have yet been taken as to the start date and location of the inquiry, but I have instructed that it be commenced as soon as possible.
