Question:

915 Mr. T. Hayes asked the Minister for Justice, Equality and Law Reform the reason for the delay in registering lands in the name of a person (details supplied) in County Tipperary; and if he will make a statement on the matter. [1182/02]

I am informed by the Registrar of Titles that this dealing refers to an application under section 49 of the Registration of Title Act, 1964, based on adverse possession of property which is already registered in the name of Kilkenny County Council. I understand that due to their complicated nature, applications under section 49, which require detailed examination of claims for registration as owners, can take some time to process. I am further informed that Kilkenny County Council has indicated its intention to lodge an objection to this application. In the circumstances, and as the registrar will have to consider any such objection on its merits, it is not possible at this point, to indicate when the dealing is likely to be completed.
