Question:

85 Mr. N. O'Keeffe asked the Minister for Agriculture, Food and Rural Development if his attention has been drawn to complications with an application for premium payments by persons (details supplied) in County Cork; if he will arrange to have these persons' application under the beef premium scheme re-examined as an overpayment has arisen; and if he will make a statement in the matter. The person named submitted an application under the special beef premium scheme in respect of 15 animals on 2 June 2000, 12 animals for the first age premium and three animals for the second age premium. However, an application for the first age premium had been submitted for five of these animals on 2 February 2000 by the previous owner. The previous owner applied for special beef premium on the five animals but his herd was restricted by disease and therefore the cattle identity cards had not been stamped and punched to indicate that the first age premium had been claimed.

When the previous owner sold his animals on 30 May 2000, an open announcement was made at the mart declaring that special beef premium had been claimed on the animals. The person named is listed as having purchased the animals from the mart on the day in question. Based on the information supplied by the mart in relation to the declaration announced on the day of sale and the mart docket submitted by the previous owner, it is clear that the previous owner was entitled to receive the special beef premium in respect of the five animals.

The person named has been asked to repay the money on these animals. This amounts to a total of €967.16 (£761.70), calculated as follows:
