Question:

181 Mr. Creed asked the Minister for Agriculture, Food and Rural Development if he will review the penalty imposed on a suckler cow grant application by a person (details supplied) in County Cork. [4562/02]

The person named applied for premium for 21 animals under the 2001 suckler cow premium scheme. Following an examination of the application it was found that three animals were disposed of within the six month retention period. The animals were not replaced as required under the terms and conditions of the scheme. A formal decision issued to the applicant on 17 January 2001 informing him that as clause 26(a) of the terms and conditions of the scheme had been contravened the three animals were being rejected with a resultant penalty on the remaining animals. The person named was also informed that he could appeal this decision by contacting my Department within 21 days. The district livestock office have recently been informed of the applicant's wish to have his case reviewed. He has been advised that his application will be examined further on submission of evidence to support his case.

The person named submitted a 2001 area aid application which included a parcel in respect of which an overclaim has been identified. Maps have issued to him and he has been informed of the extent of this overclaim. The application cannot be further processed until a reply is received. When the area aid application is fully processed and found in order payment due under the 2001 area-based compensatory allowance scheme will issue.
