Question:

385 Mr. B. Hayes asked the Minister for Justice, Equality and Law Reform if he will make a decision in the case of a person (details supplied) in Dublin 24. [5538/02]

I understand from the Garda authorities that the permission to remain which was granted to the person in question in order to study in Ireland was rescinded as his level of attendance since his arrival in the State in April 2000 had been exceptionally low. The person in question has been informed of this and advised to leave the State. In the event that he chooses not to return home, consideration will be given to whether or not a deportation order should be made in respect of him, in line with the procedures set out in the Immigration Act, 1999.
