627 Mr. G. Mitchell asked the Minister for Justice, Equality and Law Reform if he will reply to a letter from a person (details supplied) in Dublin 6W, in view of the fact that the person has now been formally accepted by a third level institution. [13856/02]

The person concerned was granted a visa and admitted to the State to enable him pursue an English language course. All non-EEA students seeking to extend their permission to remain to continue with their studies are required to provide an attendance record from the college concerned. The documentation submitted indicated that he had an attendance record of 31% and as he had failed to fulfil the minimum attendance of 80% expected of non-EEA students he was refused further permission to remain. The person in question should return to his country of origin and make a fresh application for a visa to attend his new course.
