187 Mr. Perry asked the Minister for Agriculture, Food and Rural Development if a decision will be made on a REP scheme appeal by a person (details supplied); and if he will make a statement on the matter. [13532/02]

A REPS inspection carried out by my Department in October 2001 on the farm of the person named resulted in the imposition of a 100% penalty for the removal of internal walls and hedgerows. The scheme conditions require that all such features be retained.

An appeal against the penalty has been lodged with my Department's REPS appeals committee. The appeal has been investigated and the matter will be considered by the REPS appeals committee at the earliest possible date. When a final decision is taken, the person named will be notified directly of the outcome. The REPS appeals committee is independent and its decisions are final.
