Written Answers. - Suckler Cow Quota.

158 Mr. Perry asked the Minister for Agriculture and Food if, further to Parliamentary Question No. 197 of 26 March 2002 (details supplied), he has reviewed the evidence submitted on the reasons for selling the quota and the reasons the remaining quota has to be sold; and if he will make a statement on the matter. [14393/02]

The person named held a suckler cow quota of 18 premium rights but did not use 90% of it in 2001 as is required under EU rules. He was written to in September 2001 seeking the reasons he had not used at least 90% of his quota. Following consideration of his reply, in which he said he would use the full quota in 2002, the quota of 18 premium rights was restored to him for 2002 on that basis, that is, that he would use at least 90% of the quota in 2002.

Further to my reply to Parliamentary Question No. 197 of 26 March 2002, the person named submitted further evidence, in April 2002, in support of his appeal to be allowed sell his quota. His case was reviewed having regard to the evidence and documentation supplied. My Department's view was that this evidence could not be regarded as constituting exceptional circumstances outside of his control, or circumstances which could not have been foreseen. As a result, it was not possible to rescind the original decision to refuse him permission to sell his quota and the person named was informed accordingly on 23 April 2002.

In the circumstances therefore, the decision already conveyed to the Deputy in my reply to Parliamentary Question No. 197 of 26 March 2002, must still stand. If the person concerned is not satisfied with this decision, he may lodge an appeal with the headage and premium appeals unit, Agriculture House, Dublin 2.
