Question:

115 Mr. Stanton asked the Tánaiste and Minister for Enterprise, Trade and Employment the situation pertaining to ownership of copyright of work of freelance journalists as a result of the enactment of the recent Copyright and Related Rights Act, 2000; the changes made by the Act in this regard; and if she will make a statement on the matter. [14838/02]

The copyright in works made by a journalist, other than works made in the course of employment, is normally owned in the first instance by that journalist as author. This is provided for by section 23 of the Copyright and Related Rights Act, 2000. It does not involve any change in ownership rules previously governed by section 10 of the Copyright Act, 1963, as far as this particular category of work is concerned.
