Question:

223 Mr. McHugh asked the Minister for the Environment and Local Government when he will commence Part 8 of the Local Government Act, 2001, dealing with local authority boundary alteration; and if he will make a statement on the matter. [20794/02]

The Local Government Act, 2001, is being implemented on a phased basis. To date about three quarters of its provisions have been commenced by way of a series of commencement orders. This is as part of a structured implementation programme as necessary regulations, circulars and other preparatory work is completed. This process will continue and the remaining provisions of the Act, including Part 8 dealing with local authority boundary alteration, will be brought into operation on foot of further commencement orders to be made over the coming months.

Pending the coming into operation of Part 8 the current law on local authority boundary alteration set out in the Local Government Act, 1991, continues to apply.
