487 Mr. Ring asked the Minister for Social and Family Affairs the reason a social welfare payment to a person (details supplied) in County Mayo is being deducted due to means from land, when in fact this person does not own land. [23276/02]

In the context of assistance schemes, income from a holding is assessable as means if the holding is owned by the customer or if he or she has the use of it. If no income is being derived from the holding its potential letting value is assessable.

The person concerned is the beneficial occupier of a holding. A deciding officer assessed his weekly means at €10, based on the potential letting value of the holding. This assessment entitles him to payment of unemployment assistance at the weekly rate of €238.
