Question:

171 Ms M. Wallace asked the Minister for Transport the distinction, with regard to penalty points, when the driver of the car is not the owner of the car; the way in which this matter is dealt with; and if he will make a statement on the matter. [25981/02]

Where an alleged penalty point offence is detected and it has not been possible to immediately identify the driver, the relevant notice is sent to the registered owner. The notice provides that where the registered owner claims that he or she was not driving or otherwise using the vehicle at the time of the commission of the alleged offence, he or she must give to the gardaí the name and address of the driver of the vehicle. On foot of receipt of this information from the registered owner, a notice will issue to the named driver, on whose licence record the points will be endorsed, either on payment of a fixed charge or a court conviction.

In the event that another person is not identified as the driver, it is a matter for the registered owner to pay the relevant fixed charge or allow the matter to proceed to court.
