Question:

208 Ms O. Mitchell asked the Minister for Education and Science if the full salary of a person (details supplied) in Dublin 16 from February 2002 to date will be restored in view of the lengthy delay in obtaining an independent medical report; if income continuance will be ensured until the circumstances have been fully examined; and if he will make a statement on the matter. [26461/02]

The independent medical report submitted in respect of the person referred to by the Deputy indicated that he was unfit for work and, in such circumstances, he was regarded as being on continued sick leave from his teaching position.

A teacher who is absent from duty because of personal illness may retain eligibility to incremental salary grant for a maximum of 365 days absence in any consecutive period of four years. The entitlement of the teacher in question to paid leave was exhausted on 22 July 2002.

This teacher has been informed that, provided his employer, the school authority, is satisfied that he is fit to resume his full teaching duties, he may regain eligibility for incremental salary grant in circumstances where: (a) prior to resumption of duty, he submits a medical report which is deemed by his employer and the chief medical officer to be satisfactory; and (b) he resumes full teaching duties in his post.
