Question:

281 Mr. Carey asked the Minister for Finance if a person (details supplied) in Dublin 11 would be liable for capital gains tax if they sold their house and emigrated; if so, the level of same; and if he will make a statement on the matter. [1560/03]

I am informed by the Revenue Commissioners that, based on the information supplied by the Deputy, the taxpayer would not be liable to capital gains tax if he sold his house in the circumstances outlined. This is because any gain on the disposal by an individual of a dwelling house which has been occupied by the individual as his or her only or main residence throughout the period of ownership is exempt from capital gains tax.
