Question:

86 Mr. Wall asked the Minister for Justice, Equality and Law Reform if a person's application (details supplied) in County Kildare for a holiday visa for their spouse and child can be investigated; and if he will make a statement on the matter. [2208/03]

The following is the position in respect of non-EEA nationals who are legally employed in the State and who wish to be joined here by visa required family members. The worker in question must have been in the State for a period of 12 months with the exception of persons employed in a limited number of high skill areas where this period is reduced to three months, and have the expectation of remaining here for at least a further 12 month period before he or she can be joined here.

In this instance, the visa applications were received in April 2002 from the persons referred to by the Deputy. These applications were refused as the worker in question had not fulfilled the above conditions. However, if the 12 month requirement has now been met, it is open to the applicants to make fresh visa applications with up to date supporting documentation and the matter will, of course, be considered anew.

Question:

87 Ms Shortall asked the Minister for Justice, Equality and Law Reform if a ruling will be made soon in the case of a person (details supplied) in Dublin 11 for their application for a travel document [2254/03]

The person in question was granted full refugee status in March 1997. He departed from the State in April 1997 and returned in September 2002. His registration has been renewed and a Garda registration certificate issued to him. A decision will be made in relation to the issuance of a travel document as soon as the unusual circumstances of the case have been fully considered.
