Question:

188 Mr. Boyle asked the Tánaiste and Minister for Enterprise, Trade and Employment if exclusion from officership of a credit union recedes after any passage of time; and if she will make a statement on the matter. [2456/03]

Under section 66 of the Credit Union Act 1997, the supervisory committee of a credit union may in certain circumstances suspend an officer of the credit union. If the officer who has been suspended does not resign within seven days, the committee must convene a special general meeting to review the suspension. At this meeting, the members of the credit union may ratify or rescind the suspension or remove the officer from office. There is no maximum time limit for such suspension if ratified by the members.

Section 96 of the Credit Union Act 1997, allows the Registrar of Friendly Societies in certain circumstances to suspend or remove from office all or any of the directors or members of the supervisory committee of a credit union. Any person removed from office under this section cannot act for a credit union for five years if the High Court so declares. Persons suspended or removed from the board of directors or the supervisory committee of a credit union pursuant to section 96 may appeal to the High Court. Similarly, the registrar may apply to the court to confirm or extend the suspension or confirm a removal. The court may make such orders as it deems necessary and may subsequently revoke or vary any order so made.
