Vol. 560 No. 4

Written Answers. - Residency Permits.

Finian McGrath

Question:

286 Mr. F. McGrath asked the Minister for Justice, Equality and Law Reform his plans to make publicly available the guidelines which will be used to determine who will or will not be granted residency on the basis of being the parents of an Irish child; if he foresees barriers to the reactivation of the claims withdrawn by asylum-seekers who may well have had strong claims for refugee status; and if he will make a statement on the matter. [3016/03]

The matter of the determi nation of residency on the basis of parentage of an Irish born child is currently the subject of discussions with the Attorney General in light of the Supreme Court judgment of 23 January, 2003.

Arrangements are in place in the Office of the Refugee Applications Commissioner for dealing with the issue of reactivation of asylum applications which have been withdrawn. Any individual with a query in this regard should contact the Office of the Refugee Applications Commissioner.
