Written Answers - Milk Quota.

Question:

224 Mr. Hayes asked the Minister for Agriculture and Food if an application for additional quota under the hardship scheme submitted by a person (details supplied) in County Tipperary will be approved; and if he will make a statement on the matter. [7013/03]

The allocation of milk quota from the national reserve is granted on the basis of recommendations from the milk quota appeals tribunal. The tribunal is a body established to consider and advise on applications for additional quota from individual producers who have suffered severe hardship in the context of the milk quota system.

The person named submitted an application to the tribunal in the 2001-02 quota year and a permanent allocation was granted to be available to him effective from 1 April 2002. He subsequently made an application to the tribunal in the current 2002-03 quota year, but as he has already received an allocation starting in this milk quota year, his application cannot be recommended for an additional allocation at this time. A letter has issued recently to him outlining the above position.

225 Mr. Hayes asked the Minister for Agriculture and Food if an application for additional quota from the 32,000,000 gallon reserve submitted by a person (details supplied) in County Tipperary which was refused and is now under appeal has been decided; and if he will make a statement on the matter. [7014/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. The person named submitted an application in relation to this quota. However, as the conditions of the scheme were not satisfied, an allocation was not made.

An appeals procedure exists in relation to this scheme and the person named has submitted an appeal. The assessment of appeals will be based on recommendations from the milk quota appeals tribunal. When the appeals process is completed each appellant will be notified of the outcome.
