Written Answers - Deportation Orders.

Question:

397 Mr. G. Mitchell asked the Minister for Justice, Equality and Law Reform if a deportation order for a person (details supplied) in Dublin 12 will be revoked. [9775/03]

The person concerned arrived in the State on 27 April 1998 and claimed asylum. His claim for refugee status was refused by the Office of the Refugee Applications Commissioner on 11 October 1998 and he was notified of this decision on 3 December 1998. This letter was re-issued on 2 July 1999. The applicant appealed this decision on 13 July 1999. The Refugee Appeals Tribunal affirmed the decision of the Office of the Refugee Applications Commissioner and he was notified of this decision on 18 October 2000.

In accordance with section 3 of the Immigration Act 1999, the person concerned was informed on the 18 October 2000 that the Minister proposed to make a deportation order in his case. In accordance with the Act, he was given the options of making representations within 15 working days setting out the reasons why he should be allowed to remain temporarily in the State; leaving the State before the order was made, or consenting to the making of a deportation order. Representations were received as to why the person should be allowed remain in the State.

His case was then examined under section 3 of the Immigration Act 1999 and section 5 of the Refugee Act 1996 – Prohibition of Refoulement. A deportation order was signed in respect of him on 8 July 2002. He was informed of this decision by letter dated 12 July 2002 and requested to attend at the Garda National Immigration Bureau on 19 July 2002 to make arrangements for his deportation. He was removed from the State on 23 August 2002.

Last January representations were received from his wife's legal representative requesting that the deportation order be revoked as he had married an Irish national in Kosovo following his deportation. I reconsidered the case file and I affirmed the deportation order on 11 March.
