Question:

89 Mr. Murphy asked the Minister for Agriculture and Food the reason a person (details supplied) in County Cork is not able to sell the quota of 6,223 gallons which is tied to a landholding. [14165/03]

The permanent transfer of land and milk quota is governed by Regulation 7 of the European Communities (Milk Quota) Regulations 2000. One of the requirements set down in that regulation is that the person proposing to sell the land and quota must have been a milk supplier in each of the three milk quota years prior to that in which the proposed transfer was to take place. The person named did not fulfil that requirement.

Question:

90 Mr. N. O'Keeffe asked the Minister for Agriculture and Food if he will extend the six month period and permit an application for a regulation 7 certificate to be approved in respect of a person (details supplied) in County Cork. [14166/03]

In view of the circumstances which apply in this case my Department is prepared to consider extending the six month limit for an application under regulation 7. There are, however, some matters in relation to the land to which the quota attaches which need to be clarified before a certificate under regulation 7 can be issued. These matters will be taken up with the person named or his legal representative.
