261 Mr. P. Breen asked the Minister for Agriculture and Food if consideration will be given regarding the application of a person (details supplied) to purchase a milk quota as a family transaction; and if he will make a statement on the matter. [15959/03]

Regulation 9 of the European Communities (Milk Quota) Regulations 2000, as amended, deals with the purchase of leased quota by the lessee on the expiry of a lease. Under that regulation, in the case of a lease of land and quota between relatives, the leased quota may be purchased only where that lease existed prior to 1 April 2001. The lease which was held by the person named does not fulfil that requirement.

The regulations provide however, that a quota holder may sell a quota along with the land to which it is attached, to a family member under certain conditions.
