87 Mr. McGuinness asked the Minister for Health and Children further to Parliamentary Question No. 404 of 25 February 2003, if such an agreement is reached if it will be applied equally to male and female nurses; if there is a circumstance in which one will or could be favoured over the other; and if he will make a statement on the matter. [16353/03]

I have been advised by the Health Service Employers Agency that the position as outlined in my reply to Parliamentary Question No. 404 of 25 February 2003 remains the same. I can confirm that health service employers are obliged to comply with the provisions of the Employment Equality Act 1998. This Act prohibits discrimination on nine distinct grounds, including gender.
