94 Mr. Allen asked the Minister for Transport if he proposes to introduce legislation to allow for the creation of residential parking zones, in view of the fact that the only measure available to solve the problem of commuter parking in residential areas is the introduction of pay parking or disc parking controls. The Road Traffic Act 1994 provides the legislative basis for the application of a broad range of measures for the parking of mechanically propelled vehicles. In particular, section 36 empowers local authorities to make by-laws for the purposes of applying paid parking schemes for the purpose of exercising controls on parking in specified areas or on specified public roads. In making such by-laws local authorities may provide for the issue of permits to residents of areas where paid parking schemes are deployed. Such permits exempt residents from the obligations to pay parking charges.

It would not be appropriate to grant exclusive parking facilities to the residents on specified public roads. Enforcement of the by-laws made under section 36 is a matter for the Garda Síochána or traffic wardens.
