Question:

173 Mr. N. O'Keeffe asked the Tánaiste and Minister for Enterprise, Trade and Employment the date redundancy payments will commence in respect of persons who received their redundancy notice in early May 2003 and whose employment will not terminate until the end of June 2003. [17196/03]

Date of notice is the key element that decides whether an employee, who has been made redundant, is entitled to payment of the enhanced statutory redundancy rate. If the employee is given notice on a date which is prior to 25 May 2003, then he/she is not entitled to payment of the new enhanced rate of the statutory redundancy lump sum. If the notice is given on or after 25 May 2003 the employee is entitled to payment at the enhanced rate. The new enhanced rate of statutory redundancy was brought into effect by regulations, namely SI No. 194 of 2003. The new Redundancy Payments Act 2003 provides for two weeks pay for each year of service plus a bonus week subject to certain conditions.
