Question:

391 Mr. McGinley asked the Minister for Justice, Equality and Law Reform the position regarding an application by a person (details supplied) in County Donegal seeking leave to remain here on humanitarian grounds. [17732/03]

The person concerned arrived in the State on 16 April 2000 and applied for asylum. His claim for refugee status was refused by the Office of the Refugee Applications Commissioner on the 3 August 2001 and he was notified of the decision on 14 September 2001. The Refugee Appeals Tribunal affirmed the decision of the office of the Refugee Applications Commissioner and the person concerned was notified of this decision on 22 April 2002.

In accordance with Section 3 of the Immigration Act 1999, the person concerned was informed on 4 July 2002 that the Minister proposed to make a deportation order in his case. He was given the alternatives of either making representations within 15 working days setting out the reasons as to why he should be allowed to remain temporarily in the State, leaving the State before the order was made or consenting to the making of a deportation order. Representations were received as to why the person concerned should be allowed remain in the State. I expect the case file in this matter to be submitted to me for a decision shortly.
