172 Mr. Timmins asked the Minister for Agriculture and Food the position in relation to the 45 day retention stock emergency legislation brought in during the foot and mouth emergency; if there are plans to drop this legislation; and if he will make a statement on the matter. [17421/03]

A period of 45 days is provided in the definitions of a dealer in both the Diseases of Animals (Amendment) Act 2001 – No. 3 of 2001 – and the Diseases of Animals 1966 to 2001 (Approval of Dealers and Dealers Premises) Order 2001 – S.I. No. 79 of 2001. This issue is amongst those being considered in this context of updating the Diseases of Animals Acts which is currently under way.
