Question:

108 Mr. Costello asked the Minister for Justice, Equality and Law Reform when a certificate of authorisation in respect of the pursuit of a Garda compensation claim by a person (details supplied) will issue; and if he will make a statement on the matter. [18186/03]

I am informed by the Garda authorities that the member was examined by the chief medical officer, Garda Síochána, on 10 January in relation to his application for compensation under the Garda Síochána (Compensation) Acts 1941 and 1945. I understand the reports of the Garda chief medical officer and the Garda Commissioner are currently being prepared.

In making my decision under section 6(1)(b) of the 1941 Act, I shall have regard to all the relevant facts of the incident including the medical reports submitted by the applicant, a report on the injury by the Garda chief medical officer and a report on the incident by the Garda Commissioner.

On receipt of the papers from the Garda authorities I would expect to be in a position to make a decision on the member's application.
