Question:

474 Aengus Ó Snodaigh asked the Minister for Justice, Equality and Law Reform the number of times the trespass provisions under the Housing (Miscellaneous Provisions) Act 2002 have been used in total, and by county, since the law was enacted; the number of convictions obtained; and the number of trespass cases still pending. [21935/03]

I am informed by the Garda authorities that section 19 of the Housing (Miscellaneous Provisions) Act 2002 has been used on 88 occasions since the legislation was enacted.

Proceedings were initiated in 30 of these cases and convictions obtained in 13 cases. I understand that four cases are currently pending before the courts. I am further informed by the Garda authorities that the statistics sought by the Deputy are not compiled on a county-by-county basis but rather on the basis of the Garda divisional boundaries.
