The person named was paid his full entitlement under the 2003 area-based compensatory allowance scheme on 30 September 2003. The person named participated in 2002 extensification premium opting for the census system for the purposes of determining eligibility.
Under the relevant EU regulation, extensification premium cannot be paid where the stocking density of the holding is greater than 1.8 livestock units per hectare. Based on the numbers of bovine animals over the age of six months declared by the person named as being present on his holding at each of the five census dates, the stocking density of the holding was found to have been 1.9157 livestock units per hectare. A cross-check against the CMMS animal database had also shown the stocking density to have been 1.9157 livestock units per hectare.
In July last, a letter was sent to the person named informing him that since the stocking density of his holding was greater than 1.8 livestock units per hectare, he could not be considered for payment of 2002 extensification premium.
