347 Ms O. Mitchell asked the Minister for Health and Children if his attention has been drawn to the fact that, despite their exemption from the smoking ban, a person (details supplied) in a hospital has been prevented from smoking; and if he will take steps to ensure that disability will not be a further disadvantage in this regard. [29882/03]

The Tobacco (Health Promotion and Protection) Regulations 1995 prohibit and restrict the consumption of tobacco products in a range of public facilities and areas. Smoking is prohibited in hospitals. It may be permitted where specific facilities are provided for staff and patients to smoke. It is the responsibility of the owner, manager or other person in charge of the facility to ensure compliance. The provision of specific facilities for smoking in the hospital referred to by the Deputy is a matter for the hospital authorities.
