PUBLIC BUSINESS. - RULES OF THE CIRCUIT COURT.

I ask the permission of the Seanad to withdraw the following motion which stands in my name on the Order Paper of to-day:

"That the Seanad approves of the ‘Rules of the Circuit Court' made by the Minister for Justice on the 16th day of March, 1928, under Section 66 of the Courts of Justice Act, 1924 (No. 10 of 1924); and that it is expedient that the said Rules shall come into operation on the 1st day of August, 1928."

As an alternative I move the following motion:

"That it is expedient that a Joint Committee, consisting of 5 members of the Dáil and 5 members of the Seanad, be appointed to consider and report on the Rules of the Circuit Court made by the Minister for Justice under Section 66 of the Courts of Justice Act, 1924 (No. 10 of 1924).

There was a misunderstanding in putting down the other motion in the form in which it appears.

CATHAOIRLEACH

I had an interview with the Ceann Comhairle, and I had intended to make a rather full statement to-day with regard to the curious and anomalous position in which this House has been placed with regard to these Rules. I do not intend to do so, because the Ceann Comhairle has informed me that probably a statement will be made in the other House to-day, and at any rate he would greatly prefer if I said nothing until we ascertained what exactly the Dáil proposes should be done. I understand that the suggestion is that these Rules should be referred for consideration to a Joint Committee of both Houses. Until we see a concrete proposal it is better to let the matter stand.

I am in the hands of the Senate. My motion was exactly to carry out what you have indicated.

CATHAOIRLEACH

It is premature. Let the motion remain on the Order Paper in the new form, and let it stand over till the next meeting of the Seanad.
