SECTION 78.

I move amendment No. 32u:

In page 65, paragraph (c), lines 6 and 7, to delete "any other drug" and substitute "any controlled drug (within the meaning of the Misuse of Drugs Acts, 1977 and 1984)".

Amendment agreed to.

Amendment No. 32w is consequential on amendments Nos. 32v and 32y and all may be taken together by agreement.

I move amendment No. 32v.:

In page 65, between lines 14 and 15, to insert the following:

"(e) fails or refuses to comply with a lawful direction given to him or her by the harbour master for the pilotage district for which he or she is licensed or employed;".

Section 56 (3) of the Bill provides that the harbour master will be the superintendent of pilots and, as such, will be giving directions to pilots in relation to pilotage services. At the request of the harbour masters, I am proposing an amendment to section 78 to provide that a pilot who fails or refuses to comply with a lawful direction given by a harbour master shall be guilty of an offence.

The insertion of "fails" before the word "refuses" on line 15 of section 78 is a technical amendment in the interests of consistency. I recommend the amendments to the Committee.

In page 65, paragraph (e), line 15, before "refuses", to insert "fails,".

Amendment No. 32y. is in my name and was taken with amendment No. 32v. The Minister is achieving in his new amendment what I was seeking to achieve through my amendment No. 32y. In view of that, I want to thank the Minister for agreeing to insert this new provision into section 78 and I will be withdrawing my amendment.

I move amendment No. 32x.:

In page 65, paragraph (e), line 18, before "the company", to insert "the master of the ship or".

Pilots, whether licensed or employed, can be required by the company or by the pilot of the ship to pilot a ship. This is a technical amendment clarifying this point in section 78 (e).
