SECTION 77.

Amendments Nos. 32t and 32u are cognate and may be taken together by agreement.

I move amendment No. 32t:

In page 64, subsection (1), lines 27 and 28, to delete "any other drug" and substitute "any controlled drug (within the meaning of the Misuse of Drugs Acts, 1977 and 1984)".

Following publication of the Harbours Bill, 1995, it was brought to my attention by both pilots and harbour masters that the word "drug" in these sections was unacceptable. For example, pilots could be on a prescribed medication while suffering from influenza or another minor ailment and still be fit to perform acts of pilotage. The views put forward are reasonable and I am, accordingly, proposing to delete the word "drug" from these sections and to replace it with the words "any controlled drug" within the meaning of the Misuse of Drugs Acts, 1977 and 1984. I recommend the amendments to the Committee.
