SECTION 77.

Amendment Nos. 46, 47 and 48 are related to amendment No. 45. Amendments Nos. 45 to 48, inclusive, may be discussed together. Is that agreed? Agreed.

I move amendment No. 45:

In page 37, between lines 43 and 44, to insert the following subsection:

"(1) The Central Fisheries Board or a Regional Fisheries Board, both within the meaning of the Act of 1980, may take such action as it considers necessary to recapture stock which has escaped from a facility operated under a licence.".

It is proposed that the central or regional fisheries boards would have standing powers to recapture escaped stock and recover any costs incurred rather than having to secure individual authorisations following a report of an escape. In the event of a fin fish escape occurring, the Central Fisheries Board or local regional fisheries board can initiate a quick response and endeavour to net escapees before dispersal.

With regard to amendment No. 47, I have proposed an amendment to give the fisheries boards, which have statutory responsibility for inland fisheries, the power to recapture stock. While I am not prepared to give such general power to licensees, I am prepared to authorise a licensee to recapture stock which has escaped from the licensee's farm. Provision is made in section 7(3)(g) regarding notification of escapes.

In page 37, subsection 910, line 47, after "person" to insert "or body".

In page 38, subsection (1), line 2, to delete "the licensee's licence" and substitute "a licence".
