SECTION 55.

Question proposed: "That section 55 stand part of the Bill."

This section could be important in relation to the acceptance or rejection of an appeal. Will the Minister explain the provisions of section 55 and how it will apply in appeals posted to the board?

Section 55 provides that in any matter relating to an appeal which is subject to a time limit in so far as submission to the board is concerned, appropriate allowance is made if on the last day of the time limit the offices of the board are closed. This section is based on section 17 of the Local Government (Planning and Development) Act, 1992. Where the last day of a period for an appeal or for submissions to be made is a Saturday, a Sunday or a public holiday or any other day on which the board's offices are closed, an appeal or submission being made to the board will be considered to have been made in time if received on the next day on which the board's offices are open.
