SECTION 17.

Amendment No. 25 is related to amendment No. 23 and amendment No. 24 is consequential on amendment No. 25. Amendments Nos. 23, 24 and 25 may be discussed together.

I move amendment No. 23:

In page 20, subsection (4), between lines 23 and 24, to insert the following:

"(b) section 12 of the Merchant Shipping Act, 1947;".

These amendments have been sought by the Minister for the Marine and are necessary to protect the lawfulness of Irish secondary legislation which gives effect to requirements of international conventions concerning the health and fitness standards of persons working at sea. These conventions are the Merchant Shipping Minimum Standards Convention, 1976, the Medical Examination Seafarers Convention, 1946, and the International Convention on Standards of Training Certification and Watchkeeping, 1995. The conventions are given effect in Irish law by regulations made by the Minister for the Marine under section 12 of the Merchant Shipping Act, 1947, and sections 3 and 8 of the Merchant Shipping (Certification of Seamen) Act, 1979.

In page 20, subsection (4), between lines 25 and 26, to insert the following:

"(c) sections 3 and 8 of the Merchant Shipping (Certification of Seamen) Act, 1979; or".
