Select Committee Town Planning Bill, 1929 debate -
Thursday, 28 Nov 1929

SECTION 14.

Section 85 of the Housing of the Working Classes Act, 1890 (which relates to inquiries by the Local Government Board) amended by the insertion of the words " powers and " before the word " duties " shall apply for any purposes of this Act, as it applies for the purpose of the execution of the powers and duties of the Local Government Board under that Act.

I move amendment 45:

To delete the section and to substitute therefor a new section as follows:—

" 14—(1) For the purposes of the execution of his powers and duties under this Act, the Minister may cause such local inquiries to be held as he may think fit, and the costs incurred in relation to such local inquiry shall be paid by the authorities and persons concerned in the inquiry, or by such of them and in such proportions as the Minister may direct, and the Minister may certify the amount of the costs incurred, and any sum so certified and directed by the Minister to be paid by any authority or person shall be a debt to the Minister for Finance from such authority or person.

(2) Sections 209 to 212 inclusive and Section 215 of the Public Health (Ireland) Act, 1878, shall apply for the purpose of any order to be made by the Minister or any local inquiry which he may cause to be held in pursuance of this Act."

As I explained at a former sitting, this amendment is merely making clear what is in the Bill provided for by reference to other Acts. It is altering the wording without making any change in the meaning. It makes clear what the Housing of the Working Classes Act, 1885, means.

Amendment put and agreed to.
Section 14, as amended, put and agreed to.
