SECTION 328.

I move amendment No. 106:

To delete subsection (2) and substitute:

" (2) This section shall not apply to a company registered under the Companies Act, 1862, or the Companies (Consolidation) Act, 1908, or to a company which has not its registered office or principal place of business in the State."

Section 328 sets out the companies that are capable of being registered under this Act. The purpose of the amendment is to make it clear that companies other than Irish ones may not avail of these registration provisions. It is hardly necessary to include it but it is being inserted for clarification.

An existing company does not need to register again. It just simply carries on?

That is right. It carries on under Part VIII.

To what section does this section correspond?

It corresponds with Section 249 in Part VII of the 1908 Act.
