309 Mr. Durkan asked the Tánaiste and Minister for Justice, Equality and Law Reform if full and fair examination of the application for refugee status has been undertaken in the case of a person (details supplied) in Dublin 8; if all aspects of the case have been fully considered; if he expects or intends to authorise grant of permanent or temporary residency; and if he will make a statement on the matter. View answerAs the Deputy will be aware, applications for refugee status in the State are determined by an independent process comprising the Office of the Refugee Applications Commissioner (ORAC) and the Refugee Appeals Tribunal (RAT) which make recommendations to the Minister for Justice, Equality and Law Reform on whether such status should be granted. As this application is the subject of judicial review proceedings it would not be appropriate for me to comment further.
