Question:

1445 Deputy Richard Bruton asked the Minister for the Environment, Heritage and Local Government the position regarding a family in the rental accommodation scheme in the event that the tenant to whom the property was assigned dies and, in particular, whether the family will succeed to the tenancy; and if they will have security in the longer term in the event that a particular landlord decided to withdraw that property from the scheme and the family needed an alternative. Section 39 of the Residential Tenancies Act 2004 sets out the circumstances in which family members of a tenant who has died may succeed to a tenancy. In the event that a landlord seeks, subject to the rights of the tenant under the Residential Tenancies Act 2004 and the terms of the availability agreement with the housing authority, to withdraw from the Rental Accommodation Scheme (RAS), the authority will move to secure alternative accommodation for the household concerned.
